Mit Beschluss vom 29.7.2017 hat der Verwaltungsrat der Europäischen Patentorganisation ein weiteres Kapitel in der Diskussion um den patentrechtlichen Schutz für Pflanzeninnovationen aufgeschlagen. Die Patentierbarkeit von Verfahren und Erzeugnissen aus dem Bereich der Pflanzenzüchtung dürfte damit allerdings nicht endgültig geklärt sein, da nun die Ausführungsordnung zum Europäischen Patentübereinkommen im Widerspruch zur Rechtsprechung der Großen Beschwerdekammer (GBK) steht. Dieser Aufsatz diskutiert den derzeitigen Stand für Patente auf Pflanzenzüchtungen, bestehende Probleme und mögliche Lösungen für einen nachhaltigen Interessenausgleich.
